Occupancy and Use
PROHIBITIONS:
Pursuant to Title 36 CFR 261.50 (a) and (b) the following act is prohibited on the area, roads, and trails described in this Order, all within the Kemmerer Ranger District, Bridger-Teton National Forest. This area is closed from December 1 through April 30th, annually.
- Possessing or using an over-snow vehicle off of National Forest System Trails or Roads in the area depicted on the Map attached hereto as Exhibit A. 36 CFR 261.56
EXEMPTIONS:
Pursuant to 36 CFR 261.50 (e) the following persons are exempt from this Order:
Persons with a permit specifically exempting them from the effect of this Order.
Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
- Forest Service road #10062 is excluded from this Order.
AREA DESCRIBED:
The closure area starts at the National Forest boundary where the Hams Fork Road (NFSR 10062) crosses the southern Forest Boundary in T2SN, RI 17W, Section IO and extends northward to the point where NFSR 10062 crosses the Hams Fork River west of the Hams Fork Campground. The east boundary of the closure area is NFSR 10062, it deviates from the road at the Elk Creek Guard Station where the boundary runs behind the guard station and ties back into NFSR 10062. The west boundary is approximately ¼ mile west of and parallel with NFSR 10062 (east boundary).
The above-described area is within the proclaimed and administrative boundaries of the Kemmerer Ranger District, Bridger Teton National Forest, Lincoln County, Wyoming.
DEFINITION:
Over-snow Vehicle. A motor vehicle that is designed for use over snow and that runs on a track or tracks and/or a ski or skis, while in use over snow. 36CFR§212.1
PURPOSE:
These restrictions are necessary to protect wintering wildlife habitat from the disturbance caused by motorized over snow vehicles, to protect natural resources (physical and biological) and separate motorized and non-motorized recreation uses to minimize user conflicts.
IMPLEMENTATION:
This Order will be in effect when signed and shall remain in effect until April 30, 2029 or until rescinded, whichever occurs first.
Any violation of this prohibition is punishable by a fine of not more than $5,000.00 for individuals, and $10,000.00 for organizations and/or imprisonment for not more than six (6) months. [Title 16 USC 551, Title 18 USC 3571(b)(6), Title 18 USC 3581(b)(7)].
- Order supersedes any previous orders prohibiting the same acts covered by this Order.
