Forest Order

PROHIBITIONS

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following acts are prohibited within the area described in this Order (the “Restricted Area”) and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, within the Tell City Ranger District, Hoosier National Forest, Perry County, Indiana.

  1. Entering or being upon or in an area described in the order as being closed. See attached map in Exhibit A. 36 C.F.R. § 261.53(e)
  2. Possession of an alcoholic beverage, as defined by State law, at the Rainbow Lake Recreation Area. See attached map. 36 C.F.R. § 261.58 (bb).

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

  1. Persons with a written Forest Service authorization specifically exempting them from the effect of this Order.
  2. Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.

RESTRICTED AREA

  1. The following section of the East Rainbow Lake area is closed: an approximate 2.33-acre area, consisting of a 100 foot no activity buffer from the Northwestern cliff edges of East Rainbow Lake as identified in Exhibit A.
    •  East Rainbow Lake is approximately 6/10th of a mile NW of the Highway 66 and Highway 70 junction in the town of Derby, IN
    • legal description as described:
          o N 1/2 SW ¼ Sec 33 T5S, R1W
          o S 1/2 NW ¼ Sec 33 T5S, R1W
  2. The Alcohol Restricted Area for Rainbow Lake Recreation Area is within Township 5S,Range 1W, Section 32, specifically all lands in and around lakes including the parking lot, as depicted in Exhibit A of this Order.

PURPOSE

The purpose of this Order is to protect public health and safety.

IMPLEMENTATION

  1. This Order will be effective when signed by the Forest Supervisor, and shall remain in effect for 5 years, or until rescinded, whichever occurs first.
  2. A map identifying the Restricted Area is attached and made part of this Order as Exhibit A.
  3. Any violation of this prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six (6) months, or both (see 16 U.S.C. § 551, 18 U.S.C. § 3571(b)(6), 18U.S.C. § 3581 (b)(7)).

  5. This Order supersedes any previous orders prohibiting the same acts covered by this Order.
