The purpose of this Order is to reduce displacement of other Forest visitors desiring to utilize a particular area, by reducing the opportunity for one visitor or group of visitors from monopolizing a campsite for long periods of time (in excess of 14 days). It also reduces the environmental impacts associated with long term established camps.

Occupancy and Use
PROHIBITIONS
Pursuant to 16 U.S.C. S 551 and 36 C.F.R. S 261.50 (a), the following is prohibited on the National Forest System (NFS) lands on the Caribou-Targhee National Forest, described below and shown on the attached map incorporated into this Order as Exhibit A (the "Described Area"):
- Camping within the same five-mile radius for more than fourteen (14) days in any thirty (30) consecutive day period. 36 CFR S 261.58(a)
- Returning to camp in any part of the five-mile radius within 30 days after having camped in the same location or any number of locations within the same 5-mile radius for 14 days in a 30-day period. 36 CFR S 261.58(a)
- Camping within % mile of any developed campground. 36 CFR S 261.58(e)
EXEMPTIONS
Pursuant to 36 C.F R. S 261.50(e), the following persons are exempt from this Order:
- Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. S 251.50(e)(1) or (2).
- Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.
DESCRIBED AREA
This Order applies to all NFS lands within the Caribou-Targhee National Forest, located in both Idaho and Wyoming.
PURPOSE
The purpose of this Order is to reduce displacement of other Forest visitors desiring to utilize a particular area, by reducing the opportunity for one visitor or group of visitors from monopolizing a campsite for long periods of time (in excess of 14 days). It also reduces the environmental impacts associated with long term established camps.
Note: If a person or group of people camp at one campsite for 14 days in a 30 consecutive day period, they must move all equipment associated with that campsite 5 radius miles and may not relocate back within that radius of the original camp for 30 days. The 30day period begins with the first day of setting up of camping equipment with the intent of camping at that location. Moving to another campsite within the minimum specified distance does not re-start the 30-day period.
IMPLEMENTATION
- This Order shall be in effect from March 30, 2023 at 1200 through March 30, 2028 at 1200, unless rescinded.

- Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter Il, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter Il, Pans 200-299, their meaning shall be determined by their plain language definitions.
- A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. S 551; 18 U.S.C. SS 3559, 3571, and 3581.
