Alcohol and Drugs Within the Ottawa National Forest - Forest Order 09-07-21-01

Forest Order
Prohibitions:
Under the authority of the Act of Congress of June 4, 1897, as amended (16 USC 551), and the Secretary of Agriculture's Regulations 36 CFR 261.S0(a) and or (b), the following acts and omissions are prohibited on the Ottawa National Forest.
- For the protection of public safety, it is prohibited to Possess, utilize, and/or distribute a controlled substance (as defined by Title 21 of the United States Code, Chapter 13, Subchapter I, Part B, Section 812) or any associated paraphernalia. 36 CFR 261.53 (c)
- Possessing or consuming an alcoholic beverage in violation of any State of Michigan statute is prohibited. 36 CFR 261.SS(bb)
These prohibitions are in addition to the general prohibitions set forth in 36 CFR 261, Subpart A. This order will be reviewed every five years to determine if the regulations are still applicable for proper management of the area described. The prohibitions will be in effect from the date of this order until specifically withdrawn by termination order of the Forest Supervisor.
Exemptions:
Pursuant to 36 CFR 26 l .50(e), the following persons are exempt from this order:
- Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty
Enforcement:
Violations of these prohibitions are punishable by a fine of not more than $5000 for an individual or $10,000 for an organization or imprisonment of not more than 6 months, or both. (16 USC 551 and 18 U.S.C. 3559)
