Forest Order

Pursuant to 36 CFR section 261.50 (a), the following are prohibited, in Kelly Pines Campground, within the Allegheny National Forest, Marienville Ranger District, until further notice.

  • Entering or using the developed camping area (sites 3, 4, 5, 6, and/or 7) of Kelly Pines Campground between May 1st and October 31st. [36 CFR Sec 261.58 (b)]

PURSUANT TO 36 CFR SECTION 261.50 (e), THE FOLLOWING ARE EXEMPT FROM THIS ORDER:

  1. Person (or persons in the company of a person) in possession and using saddle, pack, and/or draft animals for the purpose of camping and traveling on the Spring Creek Horse Trail system.
  2. Federal, State, or local law enforcement officers, or any member of an organized rescue or firefighting force in the performance of an official duty.
  3. Persons with a permit authorizing the otherwise prohibited act or omission.

Violation of either of these prohibitions is punishable by a fine of not more than $5000 for an individual or $10,000 for an organization or imprisonment for not more than six (6) months, or both, under authority of Title 16 USC 551, Title 18 USC 3559 and 3571.

Justification for Order

Mixing horse and livestock use with persons unfamiliar with such animals can pose a safety hazard to all persons involved, as well as the animals. Horses and livestock are not permitted in other developed campgrounds available for general campers. Kelly Pines Campground is designed for horse and livestock use given it’s layout, features, and location.

In addition, overnight campers without animals will often attempt to utilize these sites in order to avoid fees in other campgrounds intended for their use.

In an effort to mitigate public disagreement and to allow persons without such livestock to still utilize the general area, sites 1 and 2 of Kelly Pines Campground are not included in these prohibitions.

By implementing this order it will ensure equal and fair opportunity for everyone to enjoy the Allegheny and it will allow the Allegheny National Forest an opportunity to extend horse and livestock opportunities to the public..

Enforcement Plan

This order will be enforced by law enforcement officers as well as forest protection officers in cooperation with the site contractor. Signs will be placed in and around the campground and, in particular, at the entrance. The primary method of enforcement will be through regular patrols monitoring, education, and documentation. These patrols may or may not include other law enforcement agencies.
