  • Forest Order 09-19-17-04 Off Road Vehicles

    The following acts are prohibited on the Allegheny National Forest, Commonwealth of Pennsylvania: 

    1. Possession and/or use of an off-road vehicle upon forest trails when such vehicle is in excess of 64 inches in width. [36 CFR 261.55 (d)]
    2. Possession and/or use of any off-road vehicle upon the Penoke, Willow Creek, and/or Rocky Gap ATV/OHM Trails when such vehicle is in excess of 50 inches in width. [36 CFR 261.55 (d)]
    3. Operation or utilization (passenger) of any ORV, snowmobile, and/or motorcycle in violation of PA Title 75 Section 4581 regarding child passenger restraint systems. [36 CFR 261.55 (d)]
    4. Operating any ORV or Motorcycle on forest trails in excess of 25 miles per hour. [36 CFR 261.55 (d)]
    5. Operating any ORV or motorcycle on forest roadways in excess of 25 miles per hour or in violation of posted speed limits, whichever is less. [36 CFR 261.54 (d)]
    6. Operating any over snow vehicle on forest roadways in excess of 45 miles per hour or in violation of otherwise posted speed limits, whichever is less. [36 CFR 261.54 (d)]

Forest Order

Under the authority of the Act of Congress dated June 4, 1897, as amended (16 USC 551) aod the Secretary of Agriculture's regulation 36 CFR 261.50 (a) and (b), the following acts are prohibited on the Allegheny National Forest, Commonwealth of Pennsylvaoia: 

  1. Possession and/or use of an off-road vehicle upon forest trails when such vehicle is in excess of 64 inches in width. [36 CFR 261.55 (d)]
  2. Possession and/or use of any off-road vehicle upon the Penoke, Willow Creek, and/or Rocky Gap ATV/OHM Trails when such vehicle is in excess of 50 inches in width. [36 CFR 261.55 (d)]

DEFINITIONS:

  1. ORV: A motorized off-road vehicle, designed to be straddled by the operator, or having side by side seating and a steering wheel and is equal to or less than 64" in width and if applicable, is registered as an off-road vehicle within Pennsylvania or a reciprocal state at the time of use.
  2. OSV / Snowmobile: A motor driven vehicle designed for travel on snow or ice of a type which utilizes sled type runners or skis, or an endless belt tread, or any combination of these, or other similar means of contact with the surface upon which it is operated.

IBIS RESTRICITION IS NECESSARY TO PROTECT PUBLIC HEALTH AND SAFETY. THESE ARE IN ADDITION TO THE GENERAL PROHIBITIONS SET FORTH IN 36 CFR PART 261. TilE PROHIBITIONS WILL BE IN EFFECT FROMTIIE DATE OF IBIS ORDER UNTIL SPECIFICALLY WITIIDRA WN BY TERMINATION ORDER OF THE FOREST SUPERVISOR 

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order: 

  1. Persons with a permit authorizing the otherwise prohibited act or omission.
  2. Any Federal, State, or local officer or member or an organized rescue or :firefighting force in the performance of an official duty.

Violation of any of these prohibitions is punishable by a fine of not more than $5000 or imprisonment for not more than six (6) months, or both, under authority of Title 16 USC 551, Title 18 USC 3559 and 3571.
