UNITED STATES DEPARTMENT OF AGRICULTURE FOREST SERVICE WALLOWA-WHITMAN NATIONAL FOREST FOREST ORDER NO: 06-16-01-23-02 OVER-THE-SNOW AND WHEELED VEHICLES AREA CLOSURE 

This order supersedes Order No. 397, signed April 13, 2001, by Forest Supervisor Wood. Pursuant to 36 CFR Section 261.50(a) and (b), the following acts are prohibited, within the areas listed below within the Wallowa-Whitman National Forest. This Order will become effective on November 1, 2023 until April 15, 2024, November 1, 2024 until April 15, 2025, and November 1, 2025 until April 15, 2026, or unless rescinded sooner. 

PROHIBITIONS: 1. It is prohibited to possess or Use a Vehicle off National Forest Roads 36 CFR 261.56 2. Using any type of vehicle prohibited by this Order on the National Forest System Roads. 36 CFR 261.54(a) 3. Using any type of vehicle prohibited by this Order on National Forest System Trails 36 CFR 261.55(b) This Order prohibits the possession or use of Over-Snow Vehicles (OSV) defined as “A motor vehicle that is designed for use over snow, and wheeled vehicles within the described area below.” 

CLOSURE AREA DESCRIPTIONS The area closed to over-the-snow and wheeled vehicles starts at the intersection of Forest Service Road 43 and Forest Service Road 73; southwest along Forest Service Road 73 until the intersection of Forest Service Road 73 and Forest Service Road 7300 216. Heading southeast along Forest Service Road 7300 216 until the intersection with FS Trail 1606, then continuing southwest along the trail until it intersects with the North Fork John Day Wilderness boundary. The closure continues east along the boundary until its intersection with Forest Service Trail 1611, then north along Forest Service Trail 1611 until it intersects with Forest Service Road 73. The closure continues northwest until the intersection of Forest Service Roads 43 and 73. Forest Service Road 73 is open in accordance with Oregon Revised Statute 821.295: No Class II, Class III or Class IV all-terrain vehicles in prohibited snow areas. 

EXEMPTIONS Pursuant to 36 CFR 261.50 (e) 1 and 4, the following people are exempt from this order: 1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order) specifically exempting them from this Order. 2. Any Federal, State, or Local Officer, or member of an organized rescue or firefighting force in the performance of an official duty. 3. Anthony Lakes Mountain Resort Special Use Permittee in the operation and management of their business within the permitted area, including their staff as authorized in their Special Use Permit. These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A. 

Violations of these prohibitions are punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both. (16 (U.S.C. 551 and 18 U.S.C 3559 and 3571).
