Trail 38 on Upper Lake District closed temporarily
Trail 85438 (Trail 38) on the Upper Lake Ranger District is closed temporarily to protect public safety and natural resources. The closure of this trail section is due to recent work done on the trail which fixed numerous areas of the trail which were at risk of failing from excessive flow of water. Trail repairs included repairing and rebuilding water bars, opening drainage ditches and reestablishing inside ditches to channel water away from the trail surface. The new surface of the trail needs to settle and be compacted by precipitation for the repair to last long term. Temporarily closing Trail 85438 until it has settled will reduce resource damage and improve trail longevity. The entire OHV land system has been experiencing increased runoff from winter storms and springs since the 2018 Ranch Fire.

Pursuant to 16 U.S.C § 551 and 36 C.F.R § 261.50(b), and to provide for public safety and protect natural resources, the following act is prohibited within the Mendocino National Forest. This Order is effective from July 18, 2025, through December 31, 2025.
Being on National Forest System Trail No. 85438, between National Forest System Roads 17N39A and 17N73, as shown on the map attached as Exhibit A. 36 C.F.R. § 261.55(a).
Pursuant to 36 C.F.R § 261.50(e), the following persons are exempt from this Order:
- Any Federal, State, or local officer, or member of an organized rescue or fire-fighting force in the performance of an official duty.
- Persons with a Forest Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order, Form FS-7700-48, specifically exempting them from the effect of this Order.
This prohibition is in addition to the general prohibitions found in 36 C.F.R Part 261, Subpart A.
A violation of this prohibition is punishable by a fine of not more than $5,000 for an individual, or $10,000 for an organization, or imprisonment for not more than 6 months, or both.
