McConnell River Fishing Access
PURPOSE: The purpose of this order is to protect public health and safety. The McConnell Fishing Access Area is in close proximity to private residences, US Highway 89, and the Gardiner Airport. The closure is a permanent closure as described under Section 4103 the John D. Dingell, Jr. Conservation, Management, and Recreation Act (Public Law 116-9). It is necessary to secure public health and safety in the narrow strip of land between the neighboring airstrip and the McConnell fishing site that does not have other regulations that restrict shooting in this area. This closure combined with the existing state and federal shooting regulations provide a fully closed area adjacent to the nearby residences, developed recreation site and the airstrip to ensure public safety.
IMPLEMENTATION: This order will be in effect year round beginning upon signature and will be in effect until rescinded.

McConnell Fishing Access Area
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a),(b) and 261.58(m)the following acts are prohibited on the Gardiner Ranger District, Custer Gallatin National Forest:
PROHIBITION:
1. Discharging a firearm, air rifle or gas gun [36 C.F.R. § 261.58 (m)].
AREA CLOSURE DESCRIPTION:
The closure applies to all National Forest System (NFS) lands including roads and trails, depicted on the attached map (Attachment A) adjacent to the McConnell Fishing Access Area.

IMPLEMENTATION:
This order will be in effect year round beginning upon signature and will be in effect until rescinded. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.
EXEMPTIONS:
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:
- Persons with a permit specifically authorizing the otherwise prohibited act or omission.
- Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
VIOLATION:
Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7).
