Apalachicola National Forest Emergency Area Closure - October 9, 2018

Order # 08-15-01-18-001

Pursuant to the authorities found in 36 CFR261.50(a) and (b) and  36 CFR 261.53(e) and (f), for the personal health and safety of individuals and due to the dangerous conditions existing from the aftermath of Hurricane Michael, the following areas are closed: 

Areas Closed:

  1. All of the Apalachicola National Forest is closed
  2. Forest Service System roads and trails which are located within the Apalachicola National Forest are closed (see the attached map for the boundaries of the Apalachicola National Forest, which depicts the Forest Service System roads and trails).
  3. Developed recreation sites are closed in the area of the Apalachicola National Forest to include campgrounds, day use areas, trail heads and hunt camps (see attached list of developed areas)

Prohibited Acts:

  1. Being on a National Forest System Trail when closed by a sign, gate or barricade. Prohibited uses include horseback, motor vehicles, bicycles, and or pedestrian 36 CFR 261.55(a)
  2. Being on National Forest System Road when closed by a sign, gate or barricade. Prohibited uses include horseback, motor vehicles, bicycles, and or pedestrian 36 CFR 261.54(a)
  3. Entering or using a developed recreation site, closed by sign, gate or barricade 36 CFR0261.58(b)
  4. It is prohibited to go into or be upon any of the Apalachicola National Forest for the protection of public health and safety 36 CFR 261.53(e) and property 36 CFR 261.53(f)

Pursuant to 36 CFR 261.50(e) the following persons are exempt from the above Prohibitions:

  1. Any Federal, State, or Local Officer, or member of an organized rescue or firefighting force engaged in the performance of an official duty. 36 CFR 261.50(e)
  2. Persons working under a permit, contract, or agreement issued by a Federal, State, or Local regulatory entity which specifically authorizes activity within the area and on the roads covered by this order 36CFR 261.50(e)(1) and (6).

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A. Executed in Tallahassee, Florida this 9th day of October, 2018.

Violations of the above prohibitions set forth, are punishable by fine of not more than $5,000 for an individual and $10,000 for an organization, or imprisonment for not more than (6)six months, or both (16 USC 551 and 18 USC 3559 and 3571).
